1. Introduction

Welcome to Lariya ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our peer-to-peer delivery platform and services (collectively, the "Service") operated by Lariya Limited, a company registered in Ghana.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Acceptance of Terms

By creating an account, using our mobile application, or accessing our website, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

These Terms constitute a legally binding agreement between you and Lariya. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Description of Service

Lariya is a peer-to-peer delivery platform that connects people who need items delivered ("Senders") with travelers who are already making journeys ("Travelers"). Our Service facilitates:

  • Posting and browsing delivery requests
  • Matching senders with travelers on similar routes
  • Facilitating secure payments through our escrow system
  • Providing real-time tracking and communication tools
  • Offering insurance coverage for eligible deliveries

4. User Accounts

4.1 Account Creation

To use our Service, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.2 Identity Verification

We may require you to verify your identity by providing government-issued identification and other documentation. Failure to complete verification may result in account suspension or termination.

4.3 Account Security

You must notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account information.

5. User Responsibilities

5.1 Prohibited Items

You may not use our Service to transport:

  • Illegal substances or contraband
  • Weapons or ammunition
  • Hazardous materials
  • Perishable food items
  • Live animals
  • Cash or negotiable instruments
  • Items valued over GHβ‚΅10,000

5.2 Compliance with Laws

You agree to comply with all applicable laws and regulations in your use of the Service. This includes but is not limited to transportation laws, customs regulations, and local delivery requirements.

5.3 Accurate Information

You must provide accurate and complete information about packages, delivery requirements, and travel plans. Misrepresentation may result in account termination and legal action.

6. Payment Terms

6.1 Escrow System

All payments are processed through our secure escrow system. Payment is held until delivery is completed and confirmed by both parties.

6.2 Platform Fees

We charge a platform fee of 20% of the delivery cost. This fee is included in the total price displayed to users and covers our services, insurance, and platform maintenance.

6.3 Refunds

Refunds are processed according to our Refund Policy. Generally, refunds are available for cancelled deliveries before pickup or in cases of service failure.

7. Insurance and Liability

7.1 Insurance Coverage

Eligible deliveries are covered by our insurance policy up to GHβ‚΅10,000 per package. Coverage includes loss, theft, and accidental damage during transport.

7.2 Limitation of Liability

To the maximum extent permitted by law, Lariya's liability is limited to the amount paid for the specific delivery service. We are not liable for indirect, incidental, or consequential damages.

7.3 User Liability

Users are responsible for their own actions and the consequences thereof. Travelers are liable for packages in their possession until delivery is completed.

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We implement appropriate security measures to protect your personal information and comply with applicable data protection laws, including Ghana's Data Protection Act.

9. Termination

9.1 Termination by You

You may terminate your account at any time by contacting our support team. Upon termination, your right to use the Service will cease immediately.

9.2 Termination by Us

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion.

9.3 Effect of Termination

Upon termination, all outstanding deliveries must be completed according to the original terms. We may retain certain information as required by law or for legitimate business purposes.

10. Dispute Resolution

10.1 Internal Resolution

We encourage users to resolve disputes through our internal dispute resolution process. Our support team will investigate and attempt to resolve disputes fairly and promptly.

10.2 Arbitration

Any disputes that cannot be resolved internally will be subject to binding arbitration in accordance with the rules of the Ghana Arbitration Centre.

10.3 Governing Law

These Terms are governed by the laws of Ghana. Any legal action must be brought in the courts of Ghana.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the Service or by email. Continued use of the Service after changes constitutes acceptance of the new Terms.

If you do not agree to the modified Terms, you must stop using the Service and may terminate your account.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect. We will replace any invalid provision with a valid provision that most closely approximates the intent of the original provision.

14. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Lariya regarding the use of our Service.
